Terms of Membership.

1. About DTP Insider

DTP Insider is a free, vetted membership network operated by Deemed to Perform Consulting (ABN 53 659 644 229) for Victorian building practitioners, architects, professional engineers, and owner-builders, plus students and graduate/junior staff working under a registered practitioner.

These Terms govern your use of the service at hub.deemedtoperform.com.au. By applying for or using membership, you agree to these Terms.

2. Eligibility

You may apply for membership if you are:

  • 18 years of age or older
  • A natural person (not a company or other entity)
  • Currently one of the following in Victoria:
    • Registered with the Building and Plumbing Commission (BPC) as a building practitioner (Full member)
    • Registered with the Architects Registration Board of Victoria (ARBV) (Full member)
    • Registered with Consumer Affairs Victoria’s Professional Engineers Register (Full member)
    • Holding a current Certificate of Consent from the BPC as an owner-builder (Full member)
    • Currently enrolled in a Victorian building, architecture, or engineering qualification (Associate member — student)
    • Working under a registered practitioner in Victoria (Associate member — graduate or junior staff)

Membership is currently limited to Victoria.

3. Membership application and vetting

  • You apply via the application form at hub.deemedtoperform.com.au/apply
  • We verify your eligibility against the relevant public register or, for associates, by confirming your institution or contacting your sponsoring practitioner
  • We aim to return application decisions within 48 hours of receiving all required information. Graduate associate applications may take up to 5 business days while we await sponsor confirmation
  • We may reject an application at our discretion, without giving reasons
  • All accepted Full members have the same access; there is no paid tier

4. Your account

  • You are responsible for keeping access to your sign-in email secure
  • We use email magic links for sign-in. We don’t store passwords
  • You must notify us immediately if you believe your account has been compromised
  • You must keep your member profile accurate. You can update it via your account page

5. Membership benefits

Subject to your member class (Section 6), members get:

  • The monthly DTP Insider newsletter
  • The members-only content library (including bulletins)
  • Access to the Deemed to Perform Consulting member fee schedule
  • The partner-consultant directory
  • The tools library

Membership is currently free. We may introduce paid premium tiers in the future. Benefits available to existing members at the time of any change will remain free.

6. Full members and Associates

  • Full members (registered practitioners, architects, professional engineers, and owner-builders) have access to all v1 benefits
  • Associates (students, graduates, and junior staff) have access to the monthly newsletter, content library, and tools library. The partner directory and member-priced fee schedule are reserved for Full members
  • Associates can upgrade to Full at no charge once registered, by contacting us at hello@deemedtoperform.com.au

7. Content and intellectual property

7.1 What we own

All content published through DTP Insider that has been produced by Deemed to Perform Consulting — including practice notes, technical references, standard details, bulletins, the newsletter, the tools library, the published fee schedule, and any other materials we author, curate, or compile — is the intellectual property of Deemed to Perform Consulting (or its licensors) and is protected under Australian copyright law.

The DTP Insider name, the Deemed to Perform Consulting wordmark and logo, and the visual presentation of the service are trademarks and trade dress of Deemed to Perform Consulting.

7.2 Your licence as a member

While your membership is active and in good standing, we grant you a personal, non-transferable, non-exclusive, royalty-free licence to:

  • Access the content via the service for the purpose of your own building practice or study
  • Save personal copies of practice notes, technical references, and tool files for your own use
  • Quote brief extracts of practice notes and bulletins in your own professional work (such as a building surveyor’s report, a design submission, or course assignment), provided you attribute the source as “Deemed to Perform Consulting” with the date of the original publication
  • Use the downloadable tools library files (checklists, standard details, reference documents) for actual project work

7.3 What you must not do

Without our prior written permission, you must not:

  • Republish, distribute, broadcast, or share members-only content publicly, with non-members, or with the open internet
  • Use the content (in whole or in part) to train, fine-tune, or evaluate any artificial intelligence or machine-learning model
  • Resell, sublicense, rebrand, or commercialise the content as your own product or service
  • Remove, alter, or obscure any copyright notice, attribution, trademark, or other proprietary marking
  • Scrape, mirror, harvest, or systematically copy the content library or any other part of the service
  • Use the content in any way that would compete with Deemed to Perform Consulting’s consultancy practice (such as offering the content as part of a competing membership or advisory service)

7.4 Third-party content

Some content references or includes brief excerpts from third-party material (for example, the National Construction Code, Australian Standards, or Victorian Building Regulations). That material remains the property of its respective owners and is reproduced only as necessary for the purpose of the practice note or reference, under fair-dealing principles and applicable licences. You are responsible for ensuring your own use of any third-party material complies with the relevant licence terms.

7.5 When your membership ends

Personal copies you lawfully saved before your membership ended may be retained for your own private reference. Your licence to access new content terminates immediately on membership ending; your licence to redistribute, quote, or otherwise use any DTP Insider content beyond your own private records ceases on the same date.

8. Acceptable use

You must not:

  • Share your sign-in link or account access with anyone else
  • Misrepresent your identity, qualifications, or eligibility
  • Use the service for any unlawful purpose
  • Use any automated means to scrape, copy, or extract content (see also Section 7)
  • Use information obtained through the service to send unsolicited commercial communications to other members or partners
  • Use the partner directory to systematically compete with our partners

9. Suspension and revocation

Acting reasonably, we may suspend or revoke your membership on one or more of the following grounds:

  • Your registration with the relevant register lapses, is suspended, or is cancelled
  • You materially breach these Terms
  • You misuse member benefits (for example, high-volume content scraping or content republication)
  • Continued membership would expose us or other members to a genuine risk to safety, security, or legal compliance

Other than where a ground requires immediate action (such as a security risk or loss of registration), we will give you notice and a reasonable opportunity to respond before revoking your membership. Because membership is free, you may also end it at any time (see Section 16). Where membership is revoked, we keep an audit record under our retention policy (see Privacy Policy).

10. Deemed to Perform Consulting fee schedule

The fee schedule published to Full members shows our standard member rates for selected Deemed to Perform Consulting consultancy services. Publishing the schedule does not constitute a binding quote or offer.

10.1 Standard performance solution pricing

Standard pricing applies only to projects that meet the standard scope parameters set out in each fee schedule entry. Standard parameters typically address matters such as:

  • The class and use of the building
  • The number and complexity of performance solutions required
  • Whether the engagement is a single-stage assessment without design changes during the assessment
  • Whether the supplied documentation (plans, specifications, supporting reports) meets the minimum technical requirements published with the schedule entry
  • Any other eligibility criteria identified with the relevant service item

Where a project does not meet the standard parameters, we will tell you before commencing work and provide a custom written quote.

10.2 Custom and complex engagements

Projects that fall outside the standard fee schedule — including but not limited to multi-stage projects, projects involving multiple or interdependent performance solutions, projects requiring significant regulatory interpretation, commercial classes, dispensation applications, and bespoke consulting work — are quoted on a custom basis under our consultancy engagement terms.

10.3 Amendments after publication

If you require changes to a performance solution, report, or other deliverable after we have issued it — including changes arising from later design modifications, additional supporting information, scope changes, regulator feedback, or post-issue review requests — those changes are treated as a separate scope of work and are subject to a review fee quoted at the time. Review fees are in addition to the original engagement fee and are not covered by the published standard pricing.

10.4 Quote and acceptance

All engagements (standard or custom) are subject to a written quote from Deemed to Perform Consulting and your written acceptance under our consultancy engagement terms, which are provided separately at the time of quote. Fee schedule entries are indicative of price; they are not a substitute for an engagement.

11. Partner directory

Partner consultants listed in the directory are independent businesses. We don’t manage their work, set their prices, or guarantee their performance. When you engage a partner you contract directly with them under their own terms. We are not a party to that engagement, take no commission, and accept no liability for it.

When we describe a partner as “vetted”, we mean only that we have an existing professional relationship with them and consider them a credible referral. It is not a warranty, certification, or endorsement of their qualifications, conduct, fitness, insurance, or the quality of any work they perform. You should make your own enquiries before engaging any partner.

Partner consultants quote independently. We do not coordinate or standardise pricing across partners.

12. Communications

  • We will send you transactional emails about your membership (application status, account changes, sign-in links)
  • If you have opted in, we will send the monthly newsletter and occasional updates. Every such message identifies us as the sender and contains a working unsubscribe link, which we honour within 5 business days (Spam Act 2003 (Cth))
  • You can change your communication preferences at any time via your account, via the unsubscribe link, or by emailing hello@deemedtoperform.com.au

13. Free service — no warranties

DTP Insider is provided free of charge and as is. To the maximum extent permitted by law:

  • We don’t warrant that the service will be uninterrupted, error-free, or available at any specific time
  • We don’t warrant the accuracy or completeness of any content (including practice notes, partner profiles, or the fee schedule)
  • We don’t accept liability for any reliance you place on content provided through the service. Use of practice notes is your professional responsibility
  • Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, consequential, or special losses arising out of or in connection with the service (including loss of profit, business, opportunity, or reputation). Nothing in this clause excludes liability that cannot be excluded under the Australian Consumer Law or other applicable law.

In relation to Deemed to Perform Consulting’s professional services (including any engagement entered into via the member fee schedule): Liability limited by a scheme approved under Professional Standards Legislation. Member — Australian Institute of Building Surveyors Professional Standards Scheme.

15. Indemnification

You agree to indemnify Deemed to Perform Consulting against any claim, loss, or damage to the extent it is caused by your misuse of the service or your breach of these Terms (including the content licence in Section 7). This indemnity does not apply to the extent the loss is caused by our own act or omission, and is subject to your rights that cannot be excluded under the Australian Consumer Law.

16. Ending your membership

You can end your membership at any time by emailing hello@deemedtoperform.com.au or using the controls in your account. We will close your account on the next business day. Audit records are retained as set out in the Privacy Policy.

17. Changes to these Terms

We may update these Terms from time to time. We will notify members of material changes by email at least 14 days before they take effect. If you don’t accept a change, you may end your membership before it takes effect at no cost (see Section 16). Continued use after the effective date constitutes acceptance.

18. Governing law

These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your membership.
